A. General part

§ 1 General information

Personal data are individual details about your personal or factual circumstances, i.e. data which identify you or which can be used to determine your identity. This includes, for example, your correct name, address, telephone number or date of birth. Personal data also includes personal data, i.e. data without direct reference from which a person can be derived, such as the IP address.

Personal data includes such data that is generated in connection with the retrieval of and stored in so-called log files on the servers of DVV Media and the technical service providers.

On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation and security of our services), we collect data on every access to the server on which the service is located (so-called server log files) in accordance with Art. 6 Para. 1. lit. f GDPR.

These are the name of the accessed website, file, your IP number, date and time, browser type and the requesting provider.

For security reasons (e.g. to clarify misuse or fraud), log file information is stored for a maximum of seven days and then deleted. Data whose further storage is required for evidence purposes is excluded from deletion until the respective incident has been finally clarified.

When you visit the pages of DVV Media, personal data will also be processed automatically in anonymized form. This includes usage data such as the beginning and end of your visit, the pages you call up or the length of time you spend on the portal. This data is not used for any personal purpose.

DVV Media will only collect, process or use personal data in compliance with the relevant data protection regulations. This means that users' data will only be processed if permission has been granted by law. This means, in particular, if the data processing is necessary or legally required for the provision of our contractual services and online services, if the consent of the users has been obtained, or if it is necessary due to our legitimate interests (i.e. interest in the analysis, optimisation and economic operation and security of our services in the sense of Art. 6 Para. 1 letter f GDPR, in particular in the measurement of reach, the creation of profiles for advertising and marketing purposes, the collection of access data and the use of the services of third parties.

We would like to point out that the legal basis of the consent is Art. 6 para. 1 lit. a and Art. 7 GDPR, the legal basis for processing for the purpose of fulfilling our services and implementing contractual measures is Art. 6 para. 1 lit. b GDPR, the legal basis for processing for the purpose of fulfilling our legal obligations is Art. 6 para. 1 lit. c GDPR and the legal basis for processing for the purpose of safeguarding our legitimate interests is Art. 6 para. 1 lit. f GDPR.


§ 2 Security measures

We take organizational and technical security measures in accordance with the state of the art to ensure that the regulations of the data protection laws are observed and thus to protect the data processed by us against accidental or intentional manipulation, loss, destruction or access by unauthorized persons.


§ 3 Passing on of data to third parties and third party providers

Data will only be passed on to third parties within the framework of the legal requirements in accordance with Art. 6 para. 1 GDPR.

If we use subcontractors to provide our services, we take appropriate legal precautions as well as appropriate technical and organizational measures to ensure the protection of personal data in accordance with the relevant legal regulations.

Insofar as content, tools or other means are used by other providers (hereinafter referred to as "third-party providers") within the scope of this data protection declaration and their named headquarters are located in a third country, it is to be assumed that a data transfer to the countries in which the third-party providers are located will take place. Third countries are countries in which the GDPR is not a directly applicable law, i.e. in principle countries outside the EU or the European Economic Area. Data is transferred to third countries either if an appropriate level of data protection, user consent or legal permission is available.


§ 4 Use of cookies

Cookies are small amounts of data that are transferred from the Internet to your computer together with the data actually requested. This data is stored there and kept ready for later retrieval. DVV Media uses the following types of cookies for

1.       Session-cookies:
These are cookies that are only stored on your computer for the duration of an Internet session. These cookies are deleted when the session is ended, i.e. when you leave the website or when you close the browser window.

2.       Login cookies:

A cookie is also used for user authentication. Different cookies can be used for this purpose: By default, cookies are used which are only generated for the respective session. They store information about the user name, user rights and the validity of the session.  

3.       Google Analytics cookies (data collection for optimization purposes):
We use Google Analytics, a feature of Google Analytics, including Google signals and the User ID function. Google Analytics is a web analytics service provided by Google Inc. ("Google") and uses cookies, i.e. text files which are stored on your computer and which enable an analysis of your use of the website. The legal basis for the processing is Art. 6 para. 1 lit. a GDPR (consent).

The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. However, since we have activated IP anonymization on this website, your IP address will first be truncated by Google within member states of the European Union or in other states that are party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and only shortened there.

Google will use this information on our behalf to evaluate your use of the website for us, to compile reports on website activity for the website operator and to provide other services related to website and internet usage. This website uses Google Analytics reports on demographic characteristics, in which data from interest-related advertising by Google and visitor data from third parties (e.g. age, gender and interests) are used. § 5 Rights of the users

You have the right to request information free of charge about the personal data we have stored about you.

In addition, you have the right to correct incorrect data, to restrict processing and to object to the processing and deletion of your personal data, and to exercise your rights to data portability in accordance with Art. 20 GDPR and, in the event of the assumption of unlawful data processing, to lodge a complaint with the competent supervisory authority.

You can also revoke your consent, in principle with effect for the future.


§ 6 Deletion of data

The data stored with us will be deleted as soon as they are no longer required for their intended purpose and the deletion does not conflict with any legal storage obligations. If user data are not deleted because they are required for other and legally permissible purposes, their processing is restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to user data that must be retained for commercial or tax law reasons.


§ 7 Right of objection

Users can object to the future processing of their personal data in accordance with the legal requirements at any time. The objection may in particular be made against processing for the purposes of direct advertising.


B. Special part

We process inventory data as well as contract data for the purpose of fulfilling our contractual obligations and services, Art.6 para.1 lit. b GDPR.


§ 1 Information on the subscription to the Energie-Archiv

For subscription customers, the following data is processed as inventory data: Identification, password, name (business, if applicable), address (business, if applicable), e-mail address (business, if applicable), start date and end date of the subscription, payment frequency, payment method and account details. These data are necessary for the processing of the subscription contract.
